You grant Guardian Ops a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display your User Submissions for purposes of operating and improving the Site and our services. We are not obligated to compensate you for any User Submissions.

The Site may contain links to third-party websites, platforms, or services that are not owned or controlled by Guardian Ops. We provide these links for convenience only and do not endorse or assume responsibility for any third-party content, services, or practices.

Your use of any third-party websites or services is at your own risk and is subject to those third parties' terms and privacy policies.

6. No Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUARDIAN OPS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any content will be accurate, complete, or up to date.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL GUARDIAN OPS, ITS AFFILIATES, OR THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUARDIAN OPS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Guardian Ops and its affiliates, and their respective owners, officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site or any violation of these Terms.

9. Changes to the Site and Terms

We may modify or discontinue the Site (or any part of it) at any time without notice. We may also update these Terms from time to time. When we do, we will revise the "Last Updated" date above.

Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site.

10. Governing Law; Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site will be subject to the dispute resolution and venue provisions set forth in our MSA (if you are a client of Guardian Ops). For all other users, any such dispute will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.
